2. Services Provided

CRE8IV offers custom design and creative services, including but not limited to:

  • Branding and logo design
  • Website design and development
  • Graphic design for print and digital media
  • Content creation and copywriting

Details of each project, including deliverables, timelines, and fees, will be outlined in a signed agreement before work begins.

3. Client Responsibilities

To ensure the success of your project, you agree to:

  • Provide timely feedback, approvals, and any necessary materials.
  • Respond promptly to communications to avoid delays in project timelines.
  • Ensure that any materials you provide, such as images or text, do not infringe on third-party copyrights or intellectual property rights.

4. Payments and Fees

  • Deposits: A non-refundable deposit is required to secure your project and begin work.
  • Payment Schedule: Payments are due according to the milestones outlined in your project agreement.
  • Late Payments: Late payments may result in delayed deliverables and may incur a late fee of 10%.

5. Revisions and Scope Changes

  • The number of revisions included will be specified in your project agreement. Additional revisions or changes outside the original scope will be billed at an hourly rate of $30/hour or a mutually agreed fee.

6. Ownership and Intellectual Property

  • Upon final payment, ownership of the completed designs will transfer to you. CRE8IV retains the right to use non-confidential project materials for portfolio and marketing purposes unless otherwise agreed.
  • Source files, if not included in the scope of work, may be provided for an additional fee.

7. Cancellations and Refunds

  • Refer to our Refund Policy for details on cancellations and refunds.
  • Projects canceled after work has begun may be subject to partial refunds, taking into account work completed and time spent.

8. Confidentiality

We respect your privacy and confidentiality. Any proprietary or sensitive information shared during the project will be protected and not disclosed to third parties without your consent.

9. Limitation of Liability

CRE8IV is not responsible for:

  • Errors, omissions, or delays resulting from inaccurate information or materials provided by you.
  • Technical issues or unforeseen circumstances that may temporarily delay project completion.

Our maximum liability for any claim arising from our services will not exceed the total fees paid by you for the specific project.

10. Governing Law

These Terms of Service are governed by the laws of the State of Tennessee. Any disputes arising under these terms will be resolved in the courts located in Hamilton County, TN.

11. Modifications to Terms

CRE8IV reserves the right to update or modify these Terms of Service at any time without prior notice. Continued use of our website or services after changes are made constitutes acceptance of the revised terms.
